Court of Appeal sitting at the Supreme Court in Nairobi has upheld the election of Wajir west Member of Parliament Ahmed Kolosh.
The court in a statement said the MP was lawfully elected.
On 2 March, the High Court nullified the election of Kolosh stating that there was a deliberate plan to suppress the will of the voters.
Justice Francis Tuiyot said that the Ibrahim Sheikh had proved the results in two polling stations- Qara and Korich were manipulated in favour of the MP.
The Judge found that it the two polling stations, voters who cast their votes exceeded the number of registered voters.
The presiding judge said that there were alterations of results at Korich polling station and the presiding officer failed to countersign Form 35A to authenticate the changes.
