Court dismisses application by former Wajir clerk

NAIROBI—A high court in Nairobi Friday dismissed an application by a former Wajir County assembly clerk seeking reinstatement following his dismissal from office by the Transition Authority.

Justice Nduma Nderi said Isaack Mohamud was procedurally removed from office.

Justice Nderi ruled that the application did not have merit, saying his position was filled by the County Assembly Service Board.

Mohamud went to the court in 2013 to sue the Transition Authority accusing it of redeploying him to the local County Council.

“I was subjected to unfair administrative justice and the decision by TA was a breach of the principle of separation of powers. The TA acted in an unreasonable manner by redeploying me to an entity that does not exist,” Mohamud said.

Justice Nderi said it was clear that Mohamud had been given a temporary appointment.
